Terms and Conditions
Prepaid payment terms and the general rental contract terms of Rahoul Al Sharq Car Rental Company.
1General Terms
A. The information and details used to make the payment must belong to the same person named as the renter.
B. Upon arriving to collect the vehicle, the renter will be required to present the credit card used to make the payment.
C. The vehicle will be released to the renter after completing all required rental agreement procedures.
2Rental Terms
1. The minimum rental period is one day (24 hours).
2. The rental agreement may be extended with the approval of both the Lessor and the Lessee, provided that the agreement specifies the procedures required for such extension.
3. Any delay exceeding four hours shall be considered an additional rental day, and the minimum rental period shall be one day.
4. The cost of delayed hours, up to a maximum of four hours, shall be calculated according to the following formula: Daily Rental Rate × Number of Delayed Hours ÷ 24 × 2 = Cost of Delayed Hours
5. If the Lessee does not request an extension, or the Lessor does not approve the extension, the Lessee shall be responsible for any additional costs incurred for the excess rental period until the vehicle is returned to or recovered by the Lessor. If the delay exceeds forty-eight (48) hours, an additional charge equivalent to 50% (fifty percent) of the daily rental rate shall apply, in addition to the rental charges agreed upon in the agreement, including accident coverage costs in accordance with the terms and conditions set forth herein.
6. No amendment may be made to the agreement by either the Lessee or the Lessor after signing unless such amendment is approved and accepted by both parties.
3Lessor's Obligations
The Lessor acknowledges and undertakes to comply with the following:
1. Ensure that the vehicle is roadworthy, safe, and fit for use.
2. In the event of any technical defect in the vehicle that is not caused by negligence or misuse by the Lessee, the vehicle shall be replaced with another vehicle of the same category only.
3. Verify the original and valid official documents of the Lessee, including all required information. For Saudi citizens, the original national identification document shall be provided, and for non-Saudi residents, the original residency permit (Iqama) and driving license shall be provided.
The Lessor shall bear full responsibility arising from failure to verify the following:
A. The identity of the Lessee and any persons authorized by the Lessee to drive the vehicle.
B. A valid driving license for the driver, whether the Lessee or any person authorized under the agreement to drive the vehicle.
4Lessee's Obligations: Vehicle
The Lessee acknowledges and undertakes to comply with the following:
A. The vehicle, including its tires, engine, tools, equipment, and documents, is the property of the Lessor.
B. The vehicle has been rented to the Lessee for personal transportation purposes.
C. The Lessee shall not make any modifications to the vehicle or its equipment, including tampering with the odometer or removing the Lessor's identification sticker.
D. The Lessee confirms that they have inspected the vehicle and determined that it is suitable for their intended use.
E. The Lessee shall use the fuel and oils specified by the Lessor in the agreement while operating the vehicle.
5Acknowledgment
The Lessee acknowledges and agrees to pay the following penalties:
• SAR 1,000 (one thousand Saudi Riyals) per day for tampering with the vehicle's odometer.
• SAR 10,000 (ten thousand Saudi Riyals) for drifting or performing stunts that constitute “drifting” with the vehicle.
• SAR 100 (one hundred Saudi Riyals) per day for exceeding the rental agreement period.
6Vehicle Return
The vehicle must be returned to the location, on the date, and at the time specified in the agreement and any approved extension thereof. The vehicle must be returned in the same operating condition in which it was received, taking into consideration normal wear and tear during the rental period.
7Vehicle Recovery
The Lessor shall have the right to recover the vehicle, through the competent authorities and at the Lessee's expense, without prior notice from the Lessor, in the following circumstances:
A. Failure to return the vehicle on the specified date and time.
B. Use of the vehicle in violation of the terms and conditions of the agreement.
C. If it becomes apparent that the Lessee provided false or inaccurate information at the time of rental.
8Authorized Drivers
The following persons are authorized to drive the vehicle:
A. The Lessee, provided that they hold a valid driving license qualifying them to drive the vehicle.
B. Employees of the competent authorities in emergency situations.
9Conditions of Use
The vehicle shall not be used in any of the following circumstances:
A. By persons who are not authorized under the agreement to drive the vehicle.
B. If the vehicle requires repair.
C. If operating the vehicle may cause damage to its engine or any of its components.
D. If the authorized driver is unable to drive safely, including being under the influence of alcohol, intoxicating substances, or narcotic drugs, or suffering from any medical condition that prevents safe driving.
E. For transporting persons or goods for compensation or commercial purposes.
F. Participation in motor racing or other racing activities.
G. Towing or pulling other vehicles.
H. In a manner that constitutes negligence or reckless use.
I. Towing a trailer without the Lessor's prior approval.
J. For driving training purposes.
K. Subleasing or re-renting the vehicle.
L. For any purposes that violate the laws and regulations of the Kingdom of Saudi Arabia.
M. Outside the Kingdom of Saudi Arabia unless expressly agreed upon in the rental agreement.
10Leaving the Vehicle
The Lessee shall not leave the vehicle unattended while the ignition key is inside the vehicle or left with the vehicle.
11Insurance
The Lessor shall bear the applicable liability arising from damages caused by accidents, including coverage for third-party liability and the rented vehicle, subject to the terms and conditions of the insurance coverage.
However, the insurance shall not cover the following circumstances:
A. If the driver is under the influence of alcohol, intoxicating substances, or narcotic drugs.
B. If the driver is not authorized under the agreement to drive the vehicle.
C. If the accident occurs after the expiration of the rental period or any approved extension thereof.
D. If the vehicle is used for a purpose other than the purpose for which it was rented.
E. If the accident occurs outside the geographical area agreed upon in the rental agreement.
12Reporting Accidents and Vehicle Impoundment
A. The Lessee must immediately notify the Lessor and the competent security authorities in the event of an accident involving the vehicle or if the vehicle is discovered to have been stolen, and must provide all information requested by them.
B. The Lessee must immediately notify the Lessor if the vehicle is impounded by the competent authorities for any reason.
C. The Lessee shall be responsible for the insurance excess amount of SAR 3,000 (three thousand Saudi Riyals) per vehicle.
13Lessor's Rights
A. The Lessee may not waive, relinquish, or assign any rights belonging to the Lessor against any other party.
B. The Lessee may not represent the Lessor before any competent authority.
14Sudden Vehicle Breakdowns
A. If the vehicle requires repair due to a sudden breakdown, the Lessee shall return the vehicle to the Lessor and notify the Lessor if the vehicle is not roadworthy, so that the Lessor may arrange for its recovery.
In either case, the Lessee agrees not to carry out any repairs to the vehicle without the prior approval of the Lessor.
15Violations of Laws and Regulations
The Lessee shall bear full responsibility for the following:
A. Traffic violations caused by the driver.
B. Any other violations resulting from misuse of the vehicle or its use for unlawful purposes.
16Lessee's Personal Belongings
The Lessee shall bear full responsibility for any personal belongings left inside the vehicle.
17Rental Costs
The Lessee shall be responsible for the following costs:
A. Vehicle rental charges for the entire rental period and any extensions thereof, as specified in the agreement.
B. Insurance costs agreed upon in the agreement.
C. The cost of fuel, oil, water, and tire inflation during the rental period.
D. Costs resulting from misuse of the vehicle.
E. Costs of traffic violations caused by the driver.
F. Costs resulting from violations of applicable laws and regulations.
G. Fees for public parking facilities used by the Lessee.
H. Costs resulting from the loss, replacement, or tampering with any vehicle parts or equipment.
I. Costs resulting from late return of the vehicle beyond the specified date and time, based on the applicable rental rate category stated in the agreement, including accident coverage costs in accordance with the terms and conditions of the agreement.
J. The cost of fuel present in the vehicle at the time of rental if such fuel is used.
K. Costs of damages not covered by the insurance coverage agreed upon in the agreement.
L. Costs resulting from waiving or relinquishing the Lessor's rights against third parties.
M. Costs of repairing any modifications made to the vehicle by the Lessee.
18Vehicle Delivery Location
As a general rule, the vehicle shall be received at the location where the rental takes place, unless otherwise approved by the Lessor.
19Disputes
In the event of any dispute between the parties, the Lessor shall have the right to file a claim before the competent court in the jurisdiction where the rental agreement was concluded.
